HOME SCIENCE PAPER III - III NOTE : This paper is of two hundred (200) marks containing four (4) sections. Candidates are required to attempt the questions contained in these sections according to the detailed instructions given therein. (200) (4) S J 1206 2 SECTION - I U I Note : This section contains five (5) questions based on the following paragraph. Each question should be answered in about thirty (30) words and each carries five (5) marks. (5x5=25 marks) ( 5) (30) ( 5) (5x5=25 ) Every living being is a real or a potential consumer of goods and services, whether these are self produced for consumption or bought in exchange for money, work or other goods. Industrialization and technological development brought in its wake a number of implications which have completely changed the face of the market and the consumer environment. The Indian consumer faces problems in markets, banks, government and private offices, hospitals, schools, public distribution agencies and other services. All transactions have become more competitive and highly complex due to modern technology and development of large scale enterprises, mass production and distribution and emergence of professionals. Consumers are exposed to many hazards - physical, environmental and emotional, in the form of mal - trade practices such as adulteration, misbranding, misuse of colouring matters, unfair warranties, sales gimmicks, massive profiteering and illegal trading. These mal - trade practices pose a problem to consumers. It is high time for consumers to start educating themselves about their rights and seek protection from exploitation with the help of government and voluntary organisations. A part from the legal and other aids that are available for the protection of consumer interests, the most significant development in recent years has been the provision of redressal machinery for dealing with genuine consumer grievances. The Consumer Protection Act (CPA), 1986, is an unique one which provides for a redressal system at District, State and National level. It has two important implications J 1206 3 P.T.O. for the consumer. First, it gives the right to complain to an authority when aggrieved and seek redressal speedily without much running around. Secondly, the consumer can claim compensation for any loss or injury suffered on account of the negligence of the manufacturer. The Act applies to all goods and services in both private and public sectors, except those rendered free of charge as under a personal service contract. Any complaint of a deficiency in the service rendered to a consumer, or loss caused due to an unfair trade practices which is defined in Section 36A of the Monopolies and Restrictive Trade Practices (MRTP) Act, 1969, can form the subject of adjudication under the Act. The redressal forums are required to dispose off each complaint within three months from the date of notice served on the opposite party. In case the complaint requires that goods be tested or analysed, the case has finally to be disposed off within five months. No court fee or any other charge is paid by a complainant for the petition. There are no formalities with respect to filing the complaint. Appearance at the forum may be in person or through authorised agent and need not seek the assistance of a lawyer. The forum possesses statutory powers to direct the respondent to remove the defects in the goods under complaint, to order replacement or reimbursement of the price of goods to the complainant.
