POLITICAL SCIENCE PAPER III - III NOTE : This paper is of two hundred (200) marks containing four (4) sections. Candidates are required to attempt the questions contained in these sections according to the detailed instructions given therein. (200) (4) S D 0207 2 SECTION - I U I Note : This section contains five (5) questions based on the following paragraph. Each question should be answered in about thirty (30) words and each carries five (5) marks. (5x5=25 marks) ( 5) (30) ( 5) (5x5=25 ) Read the following passage, and answer the questions given at the end of it : Judicial activism has in recent years led some judges to issue directions to the Government not merely with regard to administration of jails but also with regard to the functioning of local bodies and even other agencies of State Government. Although the media has generally given great publicity to such pronouncements of the court and has landed those court decisions, the acclaim and appreciation has not been always unanimous and consistent. There has indeed been an equally vocal school of thought which has been unsparing in the criticism. The critic assert that the court has, by issuing directions in those matters, usurped the functions of the administrative agencies. It is also pointed out that in issuing directions in matters which are purely administrative and about which the court does not possess the requisite administrative expertise and proficiency it has overstepped its limits. Such decisions, it is stated, land the administrative agencies in practical difficulties and make them bear the brunt of decisions of the court some of which are wholly oblivious of the administrative needs and as such ill-conceived. Criticism against the above decisions is also levelled on the ground that if once the courts take it upon themselves the task of issuing diktats as to how local D 0207 3 P.T.O. bodies and other agencies should run their administration, what is there, consistently with the above approach, to prevent the courts from issuing directions as to how the State Governments and the Central Government should administer the States and the country. Would not such an approach disturb the delicate balance of distribution of powers and between the three wings of the State - the legislature, the executive and the judiciary ? Would not such approach strike at the very basis of our democratic polity which postulates that the governance of the country should be carried on by elected representatives of the people enjoying the confidence of the legislature and answerable and accountable to the people at the time of elections ?
