To, The Superintending Engineer (EI) Iron Ore Handling Plant Paradip Port Trust, Sub: - Providing Assistance in Stacker-Cum-Reclaimer-II of IOHP Ref: - Work Order No: EM/IOHP/GW-29/14/393 Dt: 15/04/2015 Dear Sir, In obedience to your letter No: EM/IOHP/GW-29/14/1060 dtd: 07 October, 2015, we are to inform you the following facts for favour of your information & kind consideration. That, the work of Providing Assistance in Stacker-Cum-Reclaimer-II work of IOHP was awarded to us vide work order No: EM/IOHP/GW-29/14/393, Dt: 15/04/2015 in our lowest quoted rates. That, we have given an undertaking as per TCN after complying with our techno commercial information and eligibility criteria which is placed at page No.232 of the agreement. That, we have already complied with contractors obligation which is mentioned at page No.75 of the agreement. That, we have made the contract which the workers for three years individually which is binding, failing which it may lead for litigation and industrial dispute. That, we have invested huge money as obligatory and supplied PPES & statutory payment of HRA, Bonus, allowances etc. to the workers That, we have invested huge amount towards purchase of tools, plants machinery, purchase material for machine and consumable for the rectification, modification new fabrication and shutdown work of mechanical, Electrical, Hydraulic and Lubrication system for the said work. That, we have not made any agreement with the Unions as instructions given at para-31.0 of page No.78 of the agreement. But it is a fear that the unions may involve in industrial Dispute, if the workers will not be continued and paid their wages as per agreement made. That, we have complied with all statutes and regulations as made in para-16.0 at page No.65 of the agreement. That, all the workers engaged are covered under EPF & ESI benefits and if the work is kept abeyance penalty from EPF & ESI Authorities will be imposed which will be against the rules and regulation of this country. That, as per para-21.0 at page-63 of the agreement clearly states that the contractors shall not claim any idle charges . That, we have deposited an amount of Rs. 9,47,421.00 in IDBI Bank, paradip Branch and a bank guarantee has been submitted to your Authority copy of which is placed at page No.248 of the agreement. The same will be blocked till completion of the work. If in between the contract is kept abeyance it is great loss to us. That, till now we are executing the work with fullest satisfaction of the Engineer-in-Charge. That, we have complied all the conditions satisfactorily as mentioned in the scope of work mentioned as page No.10 to 19 of the agreement. That, the aim of the contract is to maintain and keep ready for operation of Stacker-CumReclaimer-II in operation condition. That, if the plant will not be allowed to run it may cause for breakdown and will need for heavy expenses for major repairs due to 60% saline climate is existing in this port of paradip. That, as per our experience we may propose at least the plant will operate for testing in alternative days to make ready and fit for future operation which is called preventive maintenance. That, the plant was old one having the age of not less than 30 years and if without maintenance it will be kept it may cause breakdown and may require heavy investment for its operation. That, the plant machineries are made-up in metals which need regular greasing, oiling, cleaning, chipping, painting, hydraulic system, Electrical system (Equipment) also to protect the rust, climate and water etc. Under the circumstance and facts mentioned above we appeal before your authority that we are not willing to the agreement of keeping abeyance of contract for time being to avoid the litigation, industrial Dispute, loss of our company, depreciation of plants & its longevity and hence appeal you again not to keep the contract in abeyance on the other hand allow us to continue the work with the existing staff and machineries for which we shall be highly obliged Yours Faithfully, (Tulsi Engineering)
